Abstract

The present work aims to conduct a non-exhaustive study on the relationship between Artificial Intelligences (AIs) and copyright law, with the goal of contributing to the development of policies and regulations, based on the following question: to what extent does the use of these tools, especially ChatGPT, challenge and revolutionize the traditional understanding of human creativity and the application of copyright to such creations? To this end, a bibliographic methodology was used, based on a deductive approach. The collected data, as well as the comments derived from them, were presented in a structure of three chapters: artificial intelligence and the human experience; the impact of artificial intelligences; and copyright and artificial intelligences. In conclusion, there is no consensus on the creative capacity of machines, with the emergence of socalled algorithmic creativity leading to conflicts as data and works are used without proper permission. Regarding copyright law, conceptual obstacles arise concerning the attribution of authorship for works created by intelligent systems, indicating the need for a reformulation of legal regulations. Finally, the research points to the need for the law to seek a balance between fostering innovation and preserving human rights.
